Terms of Service | Eleventh AI LLC

Please read these Terms of Service (“Terms”) carefully before using the Eleventh AI website at https://www.eleventh.ai (the “Site”), operated by Eleventh AI LLC (“Eleventh AI”, “we”, “us”, or “our”).

By accessing or using the Site — including our AI assessment and any content or tools we make available — you agree to be bound by these Terms. If you do not agree, do not use the Site.

1. Definitions

  • Site: The website operated by Eleventh AI LLC at https://www.eleventh.ai, including all pages, tools, and content.
  • Assessment: The interactive AI assessment (quiz) and the resulting AI Opportunity Preview.
  • Services: Consulting, audit, and implementation services provided by Eleventh AI under a separate agreement.
  • User (“you”): Any individual or business accessing or using the Site.

2. Eligibility

The Site is intended for business use by individuals who are at least 18 years old. By using the Site, you represent that you meet these requirements and, if acting on behalf of a company, that you are authorized to do so.

3. Use of the Site

You agree to use the Site only for lawful purposes and in a manner that does not infringe the rights of others or restrict anyone else’s use of the Site. You may not attempt to interfere with the Site’s operation, probe or test its security, scrape its content at scale, or submit false or misleading information through the Assessment or any form.

4. AI Assessment and AI Opportunity Preview

The Assessment generates a personalized AI Opportunity Preview based on your quiz responses and publicly available information about your business (such as your website). You acknowledge that:

  • The Preview is informational only. It is a preliminary, automated analysis based on limited inputs — not a full audit, technical analysis, or implementation plan.
  • Outputs may contain inaccuracies or assumptions. Findings are validated only through a full engagement with us.
  • Any estimates of time savings, cost reduction, or ROI shown anywhere on the Site or in a Preview are illustrative and not a guarantee of results.
  • The Preview does not constitute professional, financial, or legal advice.

By submitting information through the Assessment, you grant us the right to process that information (including analyzing your publicly available website) to generate your Preview and to contact you about the results, as described in our Privacy Policy.

5. Consulting Services

Paid engagements — including AI Automation Audits and implementation work — are governed by a separate services agreement or proposal between you and Eleventh AI. If there is a conflict between these Terms and a signed services agreement, the services agreement controls for that engagement.

6. Intellectual Property

All content on the Site — text, graphics, logos, software, assessment logic, frameworks, and other proprietary material — is owned by Eleventh AI LLC or our licensors. You may not reproduce, distribute, or create derivative works from it without our prior written consent. You retain ownership of the information you submit to us; you grant us a limited license to use it to provide the Assessment and communicate with you.

7. Third-Party Links and Services

The Site contains links to and integrations with third-party services we do not control (for example, our call scheduling provider). We are not responsible for the content, policies, or practices of third parties. Review their terms and privacy policies before using them.

8. Privacy

Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference. It describes what we collect (including Assessment responses, analytics, and advertising cookies) and how we use it.

9. Case Studies

Unless restricted by a signed non-disclosure agreement or confidentiality terms in a services agreement, we may showcase work performed for clients as case studies or portfolio pieces. We will not disclose confidential or proprietary client information in doing so, and we will honor any confidentiality terms in your services agreement.

10. Disclaimer of Warranties

THE SITE AND THE ASSESSMENT ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ASSESSMENT OUTPUTS WILL BE ACCURATE OR COMPLETE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ELEVENTH AI LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SITE OR THE ASSESSMENT. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED US DOLLARS (USD $100). THIS SECTION DOES NOT LIMIT LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW, AND DOES NOT APPLY TO PAID ENGAGEMENTS, WHICH ARE GOVERNED BY THE APPLICABLE SERVICES AGREEMENT.

12. Indemnification

You agree to indemnify and hold harmless Eleventh AI LLC and its officers, contractors, and partners from claims, damages, and expenses (including reasonable legal fees) arising from your violation of these Terms or your misuse of the Site.

13. Modifications to These Terms

We may update these Terms from time to time. We will post the updated version on the Site with a revised “Last updated” date, and for material changes we will provide reasonable notice on the Site. Your continued use of the Site after changes take effect constitutes acceptance.

14. Governing Law and Dispute Resolution

These Terms are governed by applicable European Union law. Before initiating any formal proceeding, both parties agree to first attempt to resolve the dispute informally by contacting the other party. Any dispute that cannot be resolved informally will be resolved through binding arbitration on an individual basis, except where applicable law gives you the right to bring a claim in court or prohibits class action waivers. Nothing in this section limits mandatory consumer rights under applicable law.

15. Termination

We may suspend or terminate your access to the Site if you violate these Terms or if your conduct harms the security or functioning of the Site. Sections 6, 9, 10, 11, 12, and 14 survive termination.
